/PG/ Schuyler County, New York (Signal High) for PowerGames.Online —– Just days after being named in a federal investigation, Montour Town Court judge Donald R. Spaccio has resigned. Spaccio received notification that he is being investigated for his participation in the January 6th insurrection. According to local media reports, he is also being investigated for allegations of misconduct.
In April, 2024, the commission investigating the insurrection informed Spacco that he was being investigated for (a) attending the rally in Washington, D.C; (b) obstructing police and refusing to remove a propane cannon from a rooftop; and (c) unlawfully using his judicial powers in a personal dispute with a Montour code enforcement officer. Spaccio claims the cannon was to scare off birds.
Spaccio has openly expressed his pride in participating in the riot. He claims to have no remorse for his actions; however, he denies forcing entry into the capital building – a point fallen on deaf ears. Spaccio acknowledges that judges are strictly prohibited from participating in political activities outside of their own elections.
Spaccio has agreed never to hold judicial office ever again in future. He will officially vacate on October 7.
